Legal rights of Parents and Senior Citizens in India

Maintenance and Welfare of Parents and Senior Citizens Act, 2007 is a legislation enacted in 2007, initiated by Ministry of Social Justice and Empowerment, Government of India. According to the bill senior citizens who are unable to maintain themselves shall have the right to apply to a maintenance tribunal seeking a monthly allowance from their children or heirs. The Maintenance and Welfare of Parents and Senior Citizens Bill, 2007 seeks to make it a legal obligation for children and heirs to provide maintenance to senior citizens.

Ageing is a natural process that brings with a host of challenges in the life of the elderly, especially in their body, mind, living patterns and thought-process. May be, they have retired formally, yet an overwhelming majority of them are mentally alert and physically fit, and can make a significant contribution in the development of the nation.
